Refunds, Terms, and Conditions
At Gaspar's Dive Shop, your satisfaction with our gear and services is our top priority. However, returns may occur. Due to the nature of the equipment we offer and evolving safety concerns related to weather, there may be limitations on the return or exchange of items purchased regardless of proof of purchase. Please find our policies outlined below.
New Purchases
Our return and exchange policy is designed to ensure your satisfaction! If you need to return or exchange your new items, you can do so within 14 days of purchase. Please ensure that the products are in their original packaging and unused, along with the original proof of purchase. We're here to help you with store credit or a different item of your choice!
Used and Demo Gear Purchases
All sales of used gear are final. By making a purchase, you accept the responsibility and risk associated with buying used items. We strive to ensure that all used gear is safe for use, and the asking price reflects its life expectancy and quality.
Digital Products
All digital products, such as eLearning courses, are non-refundable and sold as final. Once a purchase is completed, it cannot be returned or exchanged, regardless of whether it has been used or activated.
Gift Cards
1. No Refunds or Exchanges
All gift card purchases from Gaspar's Dive Shop are final. Gift cards are non-refundable and cannot be exchanged for cash or other forms of credit, except where required by law.
2. Lost or Stolen Gift Cards
We are not responsible for lost, stolen, or damaged gift cards. Please treat your gift card like cash, as we cannot replace it if it is lost or used without your permission.
3. Expiration and Fees
Our gift cards do not expire, and we do not charge any maintenance or inactivity fees. They can be used anytime for services or merchandise at Gaspar's Dive Shop.
4. Use of Gift Cards
Gift cards may be used for purchases at Gaspar's Dive Shop but cannot be used to purchase additional gift cards. They may not be redeemed for cash unless required by law.
Special Orders
Special Order returns or cancellations may be subject to a 25% restocking fee and must be returned within 7 days.
Air and Nitrox Fill Cards
1. No Refunds or Exchanges
All tank fill card purchases are final. Fill cards are non-refundable and cannot be exchanged for cash or other forms of credit, except where required by law.
2. Expiration and Fees
Our fill cards do not expire, and we do not charge any maintenance or inactivity fees.
3. Use of Fill Cards
Fill cards may be used for the specific contents of the fill card purchased. It cannot be used for both air and nitrox fills. Additional fill cards can be purchased for alternative contents fills.
Group Travel

We strongly recommend purchasing travel insurance immediately upon booking your trip.

Unless otherwise stated, cancellations occurring from noon 60 days to noon 31 days prior to departure will result in a non-refundable penalty equal to deposit(s) plus 50% of remaining land costs or all unrecoverable payments, whichever is greater.

There are no refunds if cancellations occur later than noon 31 days prior to the date of departure.

If the trip is sold-out and another full-price traveler assumes the canceled reservation, we will refund the original client his or her payments with the exception of the booking and credit card fees.

We accepts payment for travel by check or credit card. Payments made by credit card will incur an additional 4% fee that will not be refunded in any event.

Gaspar's Dive Shop retains the right to cancel any trip prior to departure. If Gaspar's Dive Shop cancels a trip, it will provide a full refund of land cost, which constitutes full settlement. Gaspar's Dive Shop is not responsible for additional expenses incurred by trip members in connection with the trip. This includes, but not limited to, nonrefundable air tickets, visa fees, equipment, medical expenses, and damages of any kind if your trip is canceled or rescheduled for ANY reason.
Membership
Please note that the Membership Fee is non-refundable, and if you choose to cancel, your membership will expire at the end of the one-year term. You can easily manage your membership and terminate automatic renewal signing into your online account at www.gasparsdive.com.
Classes and Training
Please understand that we limit our enrollment for classes to provide a better learning experience for our students. Therefore, our classes sell out frequently. When you book your activity, you are holding a space that is no longer available to other students. If you must cancel your class, we respectfully request a 14-day notice from your original booking date to receive 100% refund of your tuition fee. This will allow us to offer your spot to another student. Please note, there are no refunds for eLearning or other digital products regardless of activation. We do not offer refunds for no-shows, voluntary withdrawals, or failure to complete proper medical forms/ documents as instructed at the time of enrollment.

We offer Peek Protect as an exclusive product that offers booking protection when you book online with us. If you decide to cancel your booking at your own initiative at least 24 hours before the start of your first booking and you have purchased Peek Protect, Spot will refund 100% of the protected amount listed in your confirmation email. Additional services or fees will not be refunded.

Students have one year from the date of purchase to complete their class. Once the year has expired, students will have to re-purchase the course to become certified.

If the course does not have the minimum number of students required, you will be moved to a new class or offered the option of the private course rate.

Rescheduling fees apply if the student must reschedule a course start date and requests the change within 14 days of the class date.

Rescheduling fees apply if you start the course and cannot make the published/agreed upon dates.

Occasionally inclement weather or not having the minimum required people to run a course will occur that requires rescheduling the class. The student will not be charged a rescheduling fee if this occurs.
ABSENCES AND MAKEUP FEES
A schedule is agreed upon between student and Gaspar's Dive Shop before classes begin. Gaspar's Dive Shop and its instructors are obligated to meeting said schedule. However, if a student is absent from a class session, pool dive or open water dive for whatever reason, Gaspar's Dive Shop cannot and will not be responsible for any makeup fees that may be incurred. Diving classes are sequential. You can’t go to the open water dive without first completing all of the pool sessions. Nor can Gaspar's Dive Shop or its Instructors guarantee rescheduling. Some courses are seasonal while others run once a year.
Rental Equipment- Off Site

If you choose to cancel your reserved rental gear, please do so at least 2 days prior to the scheduled pickup date to qualify a refund. Cancellations made with less than 48 hours notice will incur the full rental cost. You can reschedule your rental gear without any fees.

Once off-site rental gear has been taken from the property, no refunds will be provided, regardless of the reason for not diving, including medical issues like seasickness or ear clearing difficulties.

Gear rented off site is for a 24-hour period unless prearranged for a longer time period.

Unreturned Gear: After the initial 24 hours, unreturned gear will be additionally charged at the daily rate up to 5 days.

If gear is not returned within 5 days of the initial rental, the renter will be responsible for the full retail price of the rental items as well as the 5 day of rental charges.
Rental Equipment- GDS Classes and Charters

There are no refunds for rental gear rented to use on Gaspar's Dive Shop boat charters unless the charter is canceled, in which case the rental fee will be prorated based on the number of unused tanks.

Gear rented for use on a Gaspar's Dive Shop dive charter is per charter.

No refund will be issued if the diver opts not to dive for any reason, including medical issues such as seasickness or inability to clear their ears.

There are no refunds for rental gear if rented for classes if the diver opts not to dive or complete the course for any reason.
Charters Reservations

Divers must meet the required certifications of the charter they schedule.

No refunds or credits are offered for charter reservation cancellations made within 72 hours of the scheduled departure.

For group reservations of 2 or more people, a 5-day minimum notice is required for a full refund , or 48 hours' notice for a 50% refund. No refunds will be issued for cancellations made within 24 hours of the scheduled trip.

Inclement weather – Scuba diving often subjects divers to inclement weather conditions.

If the boat leaves the dock and divers complete a dive, and the weather subsequently turns inclement while the boat is at or between dive sites, there is no refund for the price of the charter.

If Gaspar's Dive Shop leaves the dock and then cancels the charter due to inclement weather, we will refund the cost of unused rental tanks.
Inclement Weather
Scuba diving often subjects divers to inclement weather conditions.

If the boat leaves the dock and divers complete a dive, and the weather subsequently turns inclement while the boat is at or between dive sites, there is no refund for the price of the charter.
